What This Policy Covers

This policy describes how Merlin Air LLC ("Merlin Air," "we," "us") handles information in connection with the website at merlinair.com and the forms on it.

It does not cover the separate commercial relationship you may have with us as a customer, representative, or supplier — purchase orders, quotations, warranty registrations, and manufacturer's representative agreements are governed by their own terms and by whatever we agreed to in writing. It also does not cover the independent manufacturer's representative firms listed on Find a Rep. Those are separate companies with their own practices.

If something here is unclear, email sales@merlinair.com and ask. We would rather answer the question than have you guess.

What We Collect

Everything we collect from this website, you typed into a form and pressed send. There are three of them:

• Contact form (/contact) — name, company, email address, phone number (optional), and your message.
• Rep routing form (/find-a-rep) — name, company, email address, ZIP code, project type, your message, and the sales region your ZIP resolved to.
• Selection software access request (/selections) — name, company, work email address, your role, and any notes you add.

That is the complete list of fields. We do not ask for and have no use for government identifiers, financial account numbers, or any of the special categories of personal data defined under GDPR Article 9.

Our web host also produces standard server request logs — IP address, browser user-agent, requested URL, timestamp — as any web server does. We do not build profiles from them, and we do not join them to form submissions.

What We Do Not Collect

This is a static website. It is compiled to plain HTML, CSS, and JavaScript, and it does not run an application server, a database, or a user-account system.

Specifically, as of the effective date above, merlinair.com sets no cookies, runs no analytics package, embeds no advertising or social tracking pixels, and hosts no third-party scripts other than the form service described below. There is no login, no session, no cart, and no payment processing anywhere on the site. We collect no location data beyond the ZIP code you may type into the rep routing form, which exists to point you at the right regional representative.

Nothing on this site is designed to follow you off it. There is consequently nothing to opt out of and no cookie banner to dismiss — a decision we made on purpose.

How We Use What You Send

We use form submissions to do the thing the form is for:

• Answer your question, quote your project, or route you to the manufacturer's representative who covers your territory.
• Evaluate and provision access to the Merlin selection software when that request comes in.
• Keep an ordinary business record of the correspondence — what was asked, what we answered, and what was specified — because HVAC projects have long memories and submittal questions resurface years later.

We do not sell personal information, and we do not share it for cross-context behavioral advertising. We do not run a newsletter or a marketing list, so you will not be added to one. If you write to us about a project, expect a reply about that project.

Who We Share It With

Three categories, and no others except where the law requires it:

• Formspree — the form submission service that receives what you send and forwards it to us by email. Your submission passes through and is stored on their systems as a service provider. See the Formspree privacy policy.
• Our web host and email provider — infrastructure vendors that serve the site and carry our mail.
• Merlin manufacturer's representatives — when you use the rep routing form, or when answering your question means handing it to the rep firm that covers your territory, we forward your inquiry to them. That is the point of the form. Those firms are independent businesses.

We may also disclose information where we are legally required to — valid legal process, or to establish or defend a legal claim. If Merlin Air is ever acquired or merged, business records including correspondence would transfer as part of that transaction.

Retention and Security

Form submissions live in our email and in the form service's records for as long as they are useful as business correspondence — typically the life of the project plus our ordinary record-retention period. Selection software access records persist for as long as the account is active. Ask us to delete something and we will, subject to any records we are required to keep.

Data in transit to this site and to the form service is encrypted over HTTPS. Access to the submission inbox is limited to Merlin Air personnel who need it. That said, no method of transmission or storage is perfectly secure, and we will not pretend otherwise — do not send us anything through a web form that you would not send in an ordinary email. For genuinely sensitive material, contact us and we will arrange something appropriate.

Your Choices and Rights

You can ask us to tell you what we hold about you, correct it, or delete it. Email sales@merlinair.com with the request and the address you used, and we will act on it within the time the applicable law allows. We will not charge you for it or treat you differently for asking.

Residents of California, Colorado, Connecticut, Virginia, and other states with comprehensive privacy statutes have specific rights of access, correction, deletion, and appeal, and the right not to have personal information sold or shared for targeted advertising. We do not sell or share personal information for targeted advertising, and we do not use it for automated decision-making or profiling. Residents of the United Kingdom, the European Economic Area, and Switzerland may exercise the corresponding rights under UK and EU GDPR; where we process such information, we do so on the basis of our legitimate interest in responding to a business inquiry, or on your consent, and we may transfer it to the United States, where we operate.

This site is aimed at HVAC professionals and is not directed to children. We do not knowingly collect information from anyone under 16. If you believe a child has sent us something, tell us and we will remove it.

Changes, and How to Reach Us

If we add anything to this site that changes the picture — analytics, an account system, a different form provider — we will update this page and move the effective date at the top. Material changes get a plainly worded summary here rather than a silent edit. The effective date is the fastest way to tell whether anything has moved.
