Agreement to These Terms

These terms govern your use of the website at merlinair.com, operated by Merlin Air LLC ("Merlin Air," "we," "us"). By using the site you accept them. If you do not accept them, stop using the site.

What these terms are not: they are not the contract under which we sell anything. Purchases of Merlin Controls, Merlin Fan Array, and related equipment are governed by our written quotation and terms of sale, by the purchase order accepted against it, and by any separate agreement signed between us. Where those documents and this page disagree about a commercial matter, those documents win. This page is about the website.

What This Site Is

This site is technical reference material for consulting engineers, contractors, OEMs, and building owners evaluating fan array controls. It is written to be accurate and specific, and every number on it came from a real document.

It is still, however, published marketing and reference content, which means:

Specifications subject to engineering revision. Always verify current product details with your Merlin representative or via sales@merlinair.com.

Nothing on this site is a construction document, a submittal, a stamped drawing, an installation instruction, or a substitute for the Installation, Operation, and Maintenance manual shipped with the equipment. Where the site and the current IOM or submittal package disagree, the submittal and the IOM govern. Design responsibility, code compliance, and equipment selection for a given project remain with the engineer of record and the installing contractor.

Product Information, Quotes, and Orders

Product descriptions, tier tables, performance figures, and availability statements on this site are informational and may change without notice. Publishing them is not an offer to sell, and your submitting a form is not an order.

Pricing is not published here. Quotes come from Merlin Air or from the manufacturer's representative covering your territory, are valid for the period stated on the quotation, and are subject to acceptance. Lead times, options, and configurations quoted for one project do not carry to another.

Content marked as forthcoming — features described as coming soon, or documentation not yet released — describes intent, not commitment. Do not specify against a feature that does not yet ship without confirming it in writing with us first.

Selection Software and Gated Resources

Access to the Merlin selection software and to any gated documentation is granted at our discretion, to identified professional users, for the purpose of selecting and specifying Merlin equipment. Requesting access does not entitle you to it, and we may suspend or revoke access at any time.

If we issue you credentials, they are yours alone. Do not share them, and tell us promptly if they are compromised.

Selection outputs — sizing, performance projections, sound data, electrical figures — are engineering estimates produced from the inputs you supply. Verify them against the project's actual conditions and against the submittal before you build to them. Garbage in behaves the way it always has.

Intellectual Property

The site and its contents — text, page structure, schematics and illustrations, photography, and the compiled code — are owned by Merlin Air or its licensors and are protected by copyright. "Merlin Air," the Merlin wizard mark, and the product names used on this site are trademarks of Merlin Air LLC. Other marks belong to their respective owners and appear here only to identify compatible or referenced equipment.

You may view the site, and you may download, print, and circulate the documentation and submittal material we publish for the purpose of specifying, purchasing, installing, or maintaining Merlin equipment. Keep our notices and attributions intact when you do.

You may not republish site content as your own, present it as another manufacturer's, use it in comparative advertising without our written permission, or systematically scrape, mirror, or harvest the site — by crawler, script, or model-training pipeline — beyond ordinary search-engine indexing.

Acceptable Use

Use the site for its purpose. Do not attempt to gain unauthorized access to it, its hosting infrastructure, or the form service behind it; do not probe, scan, or test its security; do not submit malware, forged headers, or false identities through the forms; do not use the forms to send unsolicited commercial messages; and do not interfere with anyone else's use of the site.

Submitting a form is a representation that you are a real person or authorized representative, that the contact information is accurate, and that you are reaching out about a genuine professional inquiry.

Third-Party Links and Services

The site links to and depends on parties we do not control. Form submissions are handled by Formspree. The map on Find a Rep points you to independent manufacturer's representative firms, each its own business with its own agreements and its own websites. Standards bodies, code authorities, and equipment manufacturers referenced in the technical pages are likewise independent.

We link to these because they are useful, not because we vouch for their content, their availability, or their practices. Their sites and services are governed by their terms, not ours.

Disclaimers and Limitation of Liability

The site is provided "as is" and "as available." To the fullest extent permitted by law, Merlin Air disclaims all warranties relating to the site and its content, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, completeness, or currency of published information. We do not warrant that the site will be uninterrupted or error-free.

To the fullest extent permitted by law, Merlin Air and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, project delay, or cost of substitute goods, arising out of your use of or reliance on this site — even if advised of the possibility. Our total aggregate liability arising from the site will not exceed one hundred United States dollars (USD 100).

None of this limits or affects the warranties that come with Merlin equipment. Product warranty is a matter of the written warranty terms accompanying the equipment and its sale, and this section does not reduce it. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

Governing Law, Changes, and Contact

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of the site or these terms will be brought exclusively in the state or federal courts located in Clay County, Florida, and you consent to jurisdiction there.

If a provision of these terms is held unenforceable, the rest stays in force. Our not enforcing a provision on one occasion is not a waiver of it.

We may revise these terms as the site changes. Revisions take effect when posted, and the effective date at the top of this page is the marker. Continuing to use the site after a revision means you accept it.
